At the inception of your case, you will need to provide notice to the other side that you are commencing a legal proceeding. This is where a process server comes in. G.S. Peoples & Associates, LLC, is ready to help you achieve service of process and assist in other related tasks.

WHAT IS A PROCESS SERVER?

Service of process is the procedure involving a plaintiff “serving” the defendant with legal documents and notice of an impending legal action against them. A process server is an individual tasked with delivering notice and documentation to the defendant. This person must be 18 years of age or older and cannot be a party to the case.

Process Server Attempt of Service

When you find yourself needing service of process, you may be concerned about process server cost. The cost will depend on the service you need and how quickly you need it done. Attempting to serve someone can include:

Regular Service: First attempt will occur within 2-3 days of receipt of request, and up to four attempts can be made within 20 days.
Rush Service: First attempt will occur the same day the receipt of request is received if received by 4 PM, and up to four attempts within 8 days.
Priority Service: First attempt will occur within one day of receipt of request, and up to four attempts within six days.
Additional Attempt: Made according to the judge’s requirements.

Process Server Rules

Process servers must follow certain rules. Most importantly, process servers cannot break the law in any way while attempting service. Specifically, process servers cannot:

Trespass,
Break and enter,
Threaten or harass,
Stalk an individual,
Pretend to be law enforcement, or
Leave papers with anyone under 18.
